The general terms and conditions applies to all users of our site and the services offered through it. You agree to the following by using this site and the services offered through it:

REGISTRATION PROCESS:

There are some portions of our site which are protected ['Protected Contents']. Access to these contents are only available to registered users. The protected contents you can view as a registered user are dependent on your access level. To be a registered user you need to follow the registration process:

  • Go to the registration page (http://www.iforg.com/register.asp), and follow the on-screen instructions [you can register using our secure server, if you so wish].
  • Registration Levels:
    • When you first register, you will be registered as a 'General User'. You will be able to access some protected contents.
    • Using an in-house algorithm, your registration may be upgraded to a 'Validated User' level. With this level, you will have access to even more contents and be able to partake in a number of activities on our sites.
    • As your relationship with Iforg® develops, you may wish to be a client. In this case your registration will be upgraded to 'Iforg Client' level.
    • In all cases, the upgrade process can take from 3 hours to longer. You may also wish to request an upgrade by completing a support ticket.
    • We reserve the right to upgrade or downgrade a registration without prior notice or offer of explanation.
  • Your login details will be emailed to the address provided automatically from our support desk. Please keep a lookout in your inbox or even your junk or spam mail folder [if you have filtering system in place].
  • All information on the site are protected by national and international trademark or copyright regulations. An unauthorised reproduction, distribution, transmission, display, publication or broadcast are expressly forbidden. You may however, request some excemption from this by following Permission request instructions.
  • By registering on our site, you agree to receive our monthly newsletter. This will tend to contain information about our current projects, products and services, any hot topics on our blog, and generally anything relating to technology and healthcare we happen to come accross in that month. We may display advertisement from sponsors in such newsletter. In all cases we will clearly mark any such advertisement.

By contacting us under the healthcare consultations services, you agree to the following specific terms and conditions in addition to the general terms and conditions:

a) You will enter into an independent consultation agreement (ICA) with us. The ICA will describe, in some detail, the service requirements (including time-scale), payments agreements (and methods), and a duration when either party may cancel this agreement.

b) The agreement is binding, in which you are only interested in the results to be achieved. We are solely responsible for the conduct and control of the work. We are not your agent or employee for any purpose. Our employees are not entitled to any benefits provided to your employees. This is not an exclusive agreement. Both parties are free to contract with other parties for similar services.

c) We agree to indemnify the Owner for any and all liability or loss arising from the performance of this agreement.

d) You will express to us in writing any specific privacy requirements relating to the service provision. We will confirm in writing, agreement (or otherwise) with any such requirements culminating in a confidentiality agreement with you.

By contacting us under the professional engagement services, you agree to the following specific terms and conditions in addition to the general terms and conditions. This specific terms and conditions of service will form the contract between us and any person or organization (the 'client') using these services to engage a professional (the 'locum') on a locum (or interim management) basis over an agreed term.

a) The client agree to remunerate the locum at a negotiated rate. Once the negotiated rate is agreed and confirmed, changes are allowed ONLY with expressed written agreement of ALL parties (client, locum and us).

b) A binding service level agreement(SLA) is agreed between the client and the locum.

c) All agreed remunerations (within the agreed time-scale) for the services provided by the locum will be paid directly to the locum.

d) The payment of Income Tax, National Insurance Contribution and other statutory payments remain the sole responsibility of the client and the locum.

e) The client will pay us an administration fee('the fee') once an engagement has been agreed and confirmed, even if the the client later cancel any such engagement. We reserve the right to charge interest on any outstanding payment on the invoice at 10% above the prevailing statutory rate.

f) The locum, and indeed the client, may seek legal redress for cancelled engagements. Any such actions will be between the client and the locum.

g) 'The fee' is dependant on the nature of engagement and is subject to change after expressed agreement between the client and us.

h) The client agree to pay us 'the fee' relating to any further services and/or engagements provided by the locum made within 365 days of the last engagement.

i) The client agrees to pay a fee (equivalent to 15% of the first full year's salary) should the locum become a permanent employee of the client.

j) Although we take great care to verify the integrity and qualification of the locum, we accept no responsibility for any acts or omissions by the locum. Neither do we accept liability for any failures by the locum to deliver the service level agreement.

k) The client will notify us of any gross professional misconduct on the part of any locum whose services were employed through us.

l) It is important to have a suitable professional indemnity insurance in place. The arrangements for any such insurance resides with the client or the locum.

By using any of our published specialist reports, you consent to the following specific terms and conditions of service in addition to the general terms and conditions.

a) We may include under the specialist reports services: reports, tools, references, continuing professional development(CPD) materials for professional users, and advertising. All materials are meant for adults who are qualified professional users. It is not a substitute for your own professional judgment as qualified professionals.

b) If you happen to be a consumer who chooses to use the level of professional information provided through specialist reports, you should NOT rely on it as medical (or technological) advice. You should be contacting your pharmacist or doctor or IT department for any medicines-related, or technology-related advice. ALWAYS consult your doctor or qualified IT professional.

c) Our priority is to provide impartial, well-researched reports in a particular area of interest. However we cannot warrant that the information is accurate, complete, up to date, free of infection by viruses, worms, Trojan horses or anything else manifesting contaminating or destructive properties, legal, legitimate, valid, correct and reliable.

d) We may include advertising banners on the pages displaying the reports, tools, references and CPD materials. In all cases, the banners will be clearly marked; separating contents from advertising. We cannot guarantee the suitability or otherwise of any contents and services provided by the advertisers. We accept no liability whatsoever for any interactions with such sites.

e) We reserve the right to determine the types of advertising that will be accepted and displayed on our site. We may reject any advertising that makes false and misleading claims.

d) When you(the 'client') commission a report through us, we warrant that we will conduct a thorough research on your behalf which will culminate in a report of high quality and standard. Your rights to confidentiality is protected in accordance with our privacy statements.

f) We reserve the right to withdraw any report(s) when used in a manner detrimental to Iforg Limited.
